Why does it take so long?
SSA's disability determination process involves multiple levels of review, including initial decisions, reconsiderations, and hearings. Each level requires medical review, vocational analysis, and adjudication. High caseloads at each level add waiting time.
Can I speed up the process?
Submitting a complete, organized claim with strong medical evidence shortens decision times. Critical or terminal cases can be expedited. Engaging a representative early reduces the chance of denial and additional appeal rounds.
What happens to back pay if I win?
Back pay is paid as a lump sum (or two installments for SSI). If you have a representative, their fee — capped by law at 25% of back pay, up to $7,200 in 2026 — is deducted before the payment reaches you.
